Waste Whisk Terms of Service
Welcome to Waste Whisk, Your Dog Waste Removal Service (“Website” and “Service”). By using our services, you agree to these Terms of Service (“Terms”). If you do not agree, you may not access or use our services.
1. Acceptance of Terms
By initiating service with Waste Whisk, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may update these Terms periodically, and any changes will be effective immediately upon posting.
2. Use of Services
You may use the Service for lawful purposes only. You agree not to engage in any activity that disrupts our operations or violates any applicable laws.
3. Pricing Policy
– Quotes: Service quotes are based on the information provided and may be subject to change after an initial yard inspection. Any adjustments will be communicated to you prior to service.
– Initial Cleaning Fee: If services are paused and later resumed, an initial cleaning fee will apply before reinstating monthly services.
4. Payment Policy
– Pre-Paid Billing Model: Waste Whisk operates on a pre-paid billing model, requiring all services to be paid in advance. Payments are processed exclusively on the 1st of each month, ensuring a seamless billing experience for our clients.
– Card on File: A valid card must be placed on file before starting your initial service. This ensures smooth and hassle-free payments for both parties. By engaging with our services and signing these Terms of Service, you acknowledge and agree to this requirement.
– Initial Payment Options for New Accounts:
– Option 1: Pay for your first service (Initial Cleaning) after it’s completed, with your first month’s billing on the same day. You must clearly communicate this choice to us before initiating service. If a discount is being offered during the month you sign up, you can enjoy that discounted price with this option!
– Option 2: Pay for your first service (Initial Cleaning) after it’s completed, with your first month’s billing starting on the 1st of the next month. (No discount is included with this option.)
– Late Payments: Payments not received by the first service day of the month may result in your account being paused until payment is made.
– Monthly Services: Payment for recurring services is due on the first of each month, prior to service. Monthly fees are based on a 52-week calendar averaged over 12 months.
5. Weather Policy
– Waste Whisk operates year-round in all weather conditions, provided it is safe for our technicians.
– If weather prevents service one week, we will perform double duty the following week, and the full monthly rate will still apply.
6. No Access Policy
You are responsible for ensuring safe and accessible entry to your yard. If service cannot be performed due to locked gates or other barriers, you will still be charged for the missed service. We will make reasonable efforts to contact you before canceling service for the day.
7. Dangerous Pet Policy
– Aggressive Pets: If your pet displays aggressive behavior, we may ask you to keep them indoors during service to ensure the safety of our technicians.
– Pet Attacks: In the rare event of a pet attack, we may pause or terminate your service. Safety is our top priority, and any form of aggression will not be tolerated.
– Pet Restraint: During service, pets should be leashed or secured at a safe distance to prevent distractions and ensure the safety of both your pet(s) and our staff.
8. Cancellation Policy
– No Contracts: You may cancel services at any time with at least 24 hours’ notice. Cancellation can be done by calling or updating your subscription through the customer portal.
– Pausing Services: Customers who pause services will be subject to initial or seasonal cleanup fees upon resuming service.
– Partial Month Refunds: Waste Whisk does not provide refunds for unused portions of service. If you cancel service on any day of the month, your subscription will be canceled immediately, and no refunds will be issued.
9. Satisfaction Guarantee
At Waste Whisk, we stand behind our work. If you’re not satisfied with a particular cleanup, notify us within 48 hours, and we’ll return to reclean your yard within 1 business day (usually the same day).
10. Customer Responsibilities
– Maintain accessible and safe entry points for our technicians.
– Notify us of any changes to the number of pets, access issues, or aggressive pets in the yard.
– Keep the yard maintained so that pet waste is visible and accessible.
– Inform household members of the scheduled service to prevent accidental dog releases.
11. Service Provider Responsibilities
– Waste Whisk is responsible for removing dog waste from accessible grassy and common areas in your yard.
12. Limitation of Liability
Waste Whisk and its affiliates assume no liability for damages to yards, gates, pets, or any other property resulting from our services.
13. Indemnification
You agree to indemnify and hold Waste Whisk harmless from any claims, damages, or expenses arising from your use of our services.
14. Termination
– Either party may terminate services at any time with written notice.
– Any unpaid balances are due immediately upon termination.
15. Governing Law
These Terms will be governed by the laws of the state in which Waste Whisk operates, without regard to its conflict of law provisions.
16. Photos and Proof of Service
Waste Whisk may take photos of serviced areas for proof of completion or quality assurance purposes. These photos will not be shared publicly without your consent.
17. Data Privacy and Security
– Waste Whisk collects and stores customer information for service purposes only. Payment data is securely processed in compliance with applicable privacy laws.
– We do not sell or share your personal data with third parties.
18. Right to Refuse Service
Waste Whisk reserves the right to refuse or discontinue service to any customer due to unsafe conditions, non-compliance with these terms, or other reasonable causes.
19. Service Limitations
– Services are provided only within the designated service area.
– We do not clean up non-pet waste or perform additional yard maintenance services.
20. Promotions and Discounts
– Promotions and discounts are subject to availability and may be limited to one per household.
– Specific conditions may apply and will be outlined in the promotional offer.
21. Damage Reporting
Customers must report any alleged damage caused by Waste Whisk services within 7 days for evaluation. Claims submitted after this period may not be honored.
22. Force Majeure
Waste Whisk is not liable for service delays or cancellations due to circumstances beyond our control, such as extreme weather, natural disasters, or emergencies.
23. Severability Clause
If any part of these Terms is found to be unenforceable, the remaining sections will remain in effect.
